Welcome to Anders Consulting Group. These Terms of Service govern your access to and use of our website, services, educational resources, and other offerings.
By accessing our website, contacting us about our services, submitting a service request, or purchasing a service, you acknowledge that you have read and understood these Terms of Service and agree to be bound by the provisions applicable to your use of our website and services.
If you do not agree with these terms, please discontinue use of our website and services.
Certain services may require a separate written agreement, service contract, consent form, or other documentation. Where applicable, those additional agreements will govern the specific services described in them.

Business Structuring and Formation
We provide business formation assistance, filing support, and consulting related to establishing and organizing businesses. Services may include assistance with LLC and corporation formation, business registration, EIN applications, and related business development considerations.
Government filing fees, registered agent services, licenses, permits, and other third-party expenses may be separate from our service fees unless otherwise stated in writing.

Specific services may include audience research, marketing strategy, platform selection, content planning, campaign support, and other services agreed upon with the client.

We provide Name, Image, and Likeness (NIL) education, personal brand development, audience development, partnership preparation, and related consulting for eligible middle school, high school, and collegiate athletes.

We may provide educational materials, presentations, curricula, publications, and other resources, including The Business of The Athlete curriculum and the book The Dynamics of Recruiting and NIL.
The availability, scope, and terms of any particular service or resource will be described on our website, in a service agreement, or in other applicable documentation.
3. Eligibility and Minors
You must have the legal capacity to enter into a binding agreement to independently accept contractual obligations.
Individuals who have not reached the age of majority in their jurisdiction may use applicable services only with the involvement, authorization, and consent of a parent or legal guardian where required by law.
For services involving middle school and high school athletes, a parent or legal guardian may be required to participate in consultations, approve service agreements, authorize the handling of information, and provide other necessary permissions.
Participation in our services does not guarantee athletic eligibility, recruiting opportunities, NIL compensation, sponsorships, or approval from a school or governing organization.
4. Client Responsibilities
Clients agree to:
- Provide accurate, complete, and current information when requesting or receiving services.
- Review information and documents submitted on their behalf and promptly identify errors or omissions.
- Respond to requests for information, approvals, signatures, and supporting documentation within reasonable timeframes.
- Ensure they have the authority to provide any information, images, logos, documents, or other materials submitted to us.
- Comply with applicable laws, regulations, platform rules, school policies, and other requirements relevant to their services.
- Pay agreed-upon fees and authorized expenses in accordance with the applicable payment terms.
- Communicate respectfully and cooperate with reasonable requests necessary to perform the agreed services.
Delays caused by missing information, inaccurate documentation, client inaction, or third-party requirements may affect service timelines and outcomes.
5. Fees, Payments, and Refunds
Service fees, payment schedules, deposits, and any additional expenses will be communicated before a client commits to a service.
Unless otherwise specified in a written agreement:
- Government filing fees and third-party charges may be separate from our consulting fees.
- Clients are responsible for expenses they have approved or agreed to pay.
- Deposits, cancellation fees, refunds, and rescheduling arrangements will be governed by the applicable service agreement and any mandatory consumer protection laws.
- Additional services or work outside the original scope may require additional fees and client approval.
No payment or refund policy in these Terms of Service is intended to eliminate rights that cannot legally be waived.
Please review the terms provided for your specific service before submitting payment.
6. No Guarantee of Results
Anders Consulting Group provides consulting, educational, administrative, marketing, and strategic services. We make reasonable efforts to provide services professionally and in accordance with the applicable agreement; however, we do not guarantee particular outcomes.
Business formation services do not guarantee government approval, registration by a specific date, profitability, financing, tax benefits, or business success.
Social media marketing services do not guarantee a specific number of followers, impressions, leads, sales, engagements, or return on investment.
Keynote speaking and educational services do not guarantee a particular response, behavioral change, or business outcome for attendees.
NIL strategy services do not guarantee brand deals, sponsorships, compensation, recruiting opportunities, athletic eligibility, or future professional opportunities.
Results may depend on factors outside our control, including government processing times, market conditions, competition, audience behavior, platform algorithms, client participation, and third-party decisions.
7. Business Formation, Filing Assistance, and Compliance
We assist clients with business formation and related administrative processes based on the information provided and the scope of the services purchased.
Clients remain responsible for reviewing their business information, making appropriate business decisions, and understanding their ongoing obligations.
Unless expressly agreed in a separate written agreement and legally authorized, our services do not constitute legal representation, tax preparation, accounting services, or formal legal or tax advice.
We do not guarantee that a particular business structure is appropriate for every client or that a filing will be accepted by a government agency.
Clients are responsible for determining whether they need advice from an attorney, accountant, tax professional, insurance professional, or other qualified adviser.
Clients must also understand that forming a business does not automatically satisfy every licensing, tax registration, reporting, insurance, or ongoing compliance requirement.
8. Social Media Marketing and Third-Party Platforms
Our social media marketing services may involve third-party platforms, including Facebook, LinkedIn, TikTok, Instagram, and other services.
These platforms operate independently of Anders Consulting Group. We do not control their policies, algorithms, availability, advertising systems, account restrictions, or decisions.
Clients are responsible for maintaining appropriate access to their accounts and complying with applicable platform rules.
Unless otherwise agreed in writing, clients retain responsibility for their advertising budgets, platform charges, and other expenses associated with their campaigns.
We are not responsible for platform outages, account suspensions, policy changes, unauthorized access outside our reasonable control, or changes in performance resulting from third-party decisions.
Any access to client accounts should be limited to what is reasonably necessary for the agreed services and handled in accordance with applicable security and privacy requirements.
9. NIL Strategy, Athlete Services, and Eligibility
Our NIL services are intended to provide education, brand development, strategic guidance, and related support concerning the business aspects of athletics.
NIL laws, rules, and requirements may vary depending on an athlete’s age, location, school, institution, athletic association, and level of competition. These requirements may change over time.
Athletes and their families are responsible for confirming the requirements that apply to their circumstances with the relevant school, institution, athletic association, governing body, or qualified professional.
We do not guarantee that any proposed NIL activity, sponsorship, contract, or commercial arrangement will be permitted or approved.
Unless expressly agreed in a separate written agreement and legally authorized, we do not provide legal representation, serve as a licensed athlete agent, negotiate contracts in a capacity requiring professional licensure, or provide tax or investment advice.
Athletes and their families should seek qualified legal or tax advice when appropriate, particularly before entering into sponsorship agreements or other binding contracts.
For minor athletes, parent or guardian participation and additional permissions may be necessary.
10. Keynote Speaking and Event Bookings
Speaking engagements are subject to availability and confirmation.
A booking may require a separate agreement addressing fees, deposits, travel, lodging, presentation requirements, cancellation, rescheduling, and other event arrangements.
Clients and event organizers are responsible for communicating accurate event details, venue requirements, audience information, scheduling information, and other relevant arrangements.
Any cancellation, rescheduling, travel reimbursement, or refund terms applicable to a speaking engagement will be governed by the corresponding booking agreement and applicable law.
11. Intellectual Property Rights
Unless otherwise stated in writing, the website and its original content, branding, logos, written materials, presentations, educational resources, and other proprietary materials are owned by Anders Consulting Group or used with permission.
This includes, where applicable, the intellectual property associated with The Dynamics of Recruiting and NIL and The Business of The Athlete curriculum.
You may not reproduce, distribute, republish, sell, modify, publicly display, or commercially exploit our copyrighted materials without prior written permission, except as permitted by applicable law or an applicable license.
Purchasing a service, attending a presentation, or receiving educational materials does not transfer ownership of our intellectual property.
Clients retain ownership of materials they independently own and provide to us, subject to any rights granted to us to perform the agreed services.
Any permitted use, reproduction, or distribution of our educational materials must comply with the applicable written authorization or license.
12. Website Use and Prohibited Conduct
You agree to use our website and services for lawful purposes.
You may not:
- Use our website to engage in fraud, unlawful conduct, or deceptive activities.

- Introduce malicious software or interfere with the operation of our website.
- Copy or exploit our proprietary content without authorization.
- Submit information that you know is false, misleading, or unauthorized.
- Use our services in a way that violates applicable laws or the rights of others.
We reserve the right to restrict access to our website or discontinue services when reasonably necessary due to misuse, security concerns, nonpayment, or other grounds permitted by law and any applicable agreement.
13. Privacy and Personal Information
We may collect and use personal information that you voluntarily provide through our website, communications, service requests, or client relationships.
Our collection, use, storage, and disclosure of personal information are addressed in our Privacy Policy, where available, and are subject to applicable privacy laws.
Clients should not submit sensitive personal information unless it is necessary for the service, the submission method is appropriate, and any required authorization has been obtained.
For services involving minors, additional care and appropriate parent or guardian authorization may be necessary.
Please review our Privacy Policy for more information about how we handle personal information.
14. Third-Party Services and Links
Our website may contain links to third-party websites, platforms, service providers, or resources.
These third parties operate independently, and Anders Consulting Group does not control all of their content, policies, services, or practices.
A link or reference to a third-party service does not necessarily constitute an endorsement.
Your use of third-party services is subject to the terms and policies established by those providers.
15. Limitation of Liability
To the extent permitted by applicable law, Anders Consulting Group will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of our website or services.
To the extent permitted by applicable law, we will not be responsible for losses resulting from third-party actions, government processing delays, platform changes, client-provided inaccuracies, or outcomes that depend on factors outside our reasonable control.
Nothing in these Terms of Service excludes or limits liability that cannot legally be excluded or limited under applicable law.
Any additional limitations of liability in a separate service agreement will apply only to the extent they are lawful and enforceable.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, and reasonable expenses arising from your material breach of these Terms of Service, your unlawful conduct, or your unauthorized use of third-party materials.
This provision does not require you to indemnify Anders Consulting Group for losses caused by our own negligence, willful misconduct, or other conduct to the extent such indemnification would be prohibited by law.
Any additional indemnification obligations must be consistent with applicable law and any relevant written agreement.
17. Termination of Services
We may suspend or terminate access to our website or discontinue services when permitted by law and any applicable service agreement, including where there is material nonpayment, misuse of services, unlawful conduct, or a material breach of agreed terms.
Clients may discontinue services in accordance with the cancellation and termination provisions of their applicable service agreement.
Termination does not eliminate payment obligations already incurred or other rights and obligations that, by their nature or by law, continue after termination.
18. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our business, services, website practices, or applicable legal requirements.
Updated terms will be posted on our website with a revised effective date.
Changes will apply prospectively to the extent required by law. Where additional notice or consent is legally required, we will follow the applicable requirements.
Your continued use of our website after updated terms become effective constitutes acceptance of the revised terms to the extent permitted by applicable law.
19. Governing Law and Dispute Resolution
These Terms of Service will be governed by the laws of [Insert State], without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising from these Terms of Service will be addressed in accordance with applicable law and any dispute resolution provisions in an applicable written service agreement.
Nothing in this section limits any rights or remedies that cannot legally be waived.
20. Severability and Entire Agreement
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
These Terms of Service, together with any applicable service agreement, booking agreement, policy, or written addendum, govern the matters addressed in those documents.
If a separate written service agreement conflicts with these general Terms of Service, the specific agreement will control for the service in question to the extent stated in that agreement and permitted by law.
